Court Hears Of Doctor's Earnings
DUNEDIN, Mkrch 8.' Possession of rooms at 141 High Street was awarded to Dr. D. (4. MeMiJian, a former Minister of Marine ir. the Labour Government, by Mr. H. W. Bundle, S.M., in the Magistratfe 's Court today. The def'endant was Dr. R. L. Cotton, who has lattely been practising in a group with Dr. McMilJan. The .Magistrate agrfeed to suspend thfe issue of a warrant for pbssession for 10 days to allow Dr. Cotton to taktj further action if desired. It was stated? at the hearing that Dr. . Cotton had refused to be transferred by Dr .McMillan from thfe rooms in question to otber rooms in Dowiing Rtreet, and Dr. Cotton gave evidence that in one year and eight months in the High Street rooms he had earnfeu £8600 gross.
The Court was called on to decide whether the relationship between the two' was that of master and servant, or otherWise, and the Magistrate held that the status of the parties was that of master and servant. Under an agreement Dr. McMillan paid the rent of the rooms and was surely entitled to say. what the rooms were most suitable for. Dr. McMillan claimed £5 damages and the Magistrate awarded . nomiua! damage at £1, with court cos'ts £1 3s, and solicitors ' fees £2 2a.
