Possession Of Farm Cottage Claimed
. Claiming -possession of a fourroomed cottage on a sheep farm at Waikanae, Walter Horrobin- proceeded against Elsie Gibbard in tlie Magistrate's Court, Otaki on Thursday. • Mr. A. M. Goulding, S.M., heard the case. ^ Plaintiff . stated defendant occupied the cottage on* his farm, but had n? tenahcy. At the time of taking the, oecupancy defendant's husband was working for him. The husband could not be located now, but had he been an efficient worker he would have retained his service. Defendant said she did not know where her husband was. She had five young children and wanted time to secure another house. Mr C. F. Atmore, for defendant, asked for a non-suit on the ground that plaintiff had closed his case without bringing evidence of the capital valuation of the property to bring the matter within the jurisdietion of the court. • The magistrate replied that he wouid allow plaintiff to reopen his case, and evidence was then given ithat the valuation of the house j was £1000. I ' Mr. Goulding said there did not lappear to be a tenancy in exist- ; ence and he would make an order for possession to remain in the court until April. 7.
