DEFENDED CIVIL CLAIM
In the Magistrate's Court, Otaki, on Thursday, E. A. Dickson ar d A. Te Puni, represented by Mr. B. H. Rhodes, claimed from J. A. Higgs the sum of £42 19s 3d. In addition Dickson claimed £12 5s from Pliggs. For the plaintiffs it was stated that defendant desired alterations co motor vehicles, one of which was conversion from a car to a truck. The work had been carried out last year. Higgs had appeared satisfied when the work' was completed-. There had \only been a small dispute and 5s had been deducted from the account. Prior to the commencement of ihe work the price had been mentioned ard Higgs appeared satisfied: Alterations of a substantial nature had been made and plai'ntiffs claimed that the charge was reasonable. Francis Smith, who had beeu a contractor for 21 years and an employee in the railway workshops for a number of years, said he had seen the work done and considered the charges reasonable. Defendant mairtained that he had been overcharged and testified that the cost of the whole of the work was not to exceed £40. The magistrate, Mr. A. M. Goulding, gave judgmenu for £40 7s 3d on the firU claim and £10 17s 6d on the second. Court costs (£2 5s) , solicitors' fee (£5 4s) and witnesses expenses (£2 10s) were allowed.
