AYha(§y.er tlie result of the' litigation, however', Murphy was williilg' and proposed that there bfe: .sifbstrttited for the present inquiry an inquiry before some members of the legal • profession to be agreed upon between the council 's and his solicitors, on the foliowing basis: — "Proeeedings to be open to the public aud newspapers, the council or some representative to appear as a party and to present written and specific eharges against Murphy, 110 charges to be laid in relation to any remuneration reeeived by Murphy or any opponent of his from the Hutt Valley Boxing Association or as percentage 011 iilm or radio rights, Murphy to appear as defendant to the charges, the law of evideuce to apply as ou a trial on indietment, the tribunal to have power in its diseretion to impose any penaltv contemplated by tiie rules and power to fix costs, the whole of the costs of the proeeedings to be paid by the loser or, if the council preferred it, cach party to pay its own costs and liaif the costs of the tribunal itself. it is a further condition that the inquiry now proposed be set on foot forthwith.
