DECISION RESERVED IN BOS MURPHY CASE

WELLINGTON, March 31. The hearing was continued in the Bupreine Court today on the motion oi the New Zealand lioxing Gouncil that the interim injunction granted Bos Murphy be dissolved. Murphy's counsel, Mr. R. E. Harding, presented at some lengtli submissions regarding the interpretations of the rulesv. of boxing under wliich the council suspended Murphy's lieense, saying that if there was a con flict between the rules, it would have to be resolvcd in favour of natural jus tice, involving giving a man notice oi what he was charged with, and .an op portunj.ty to be heard. The notice given to Murphy was clearly insuflicient, he said. The coun cil had written to the latter ten days. after his suspension indicating thaj" his condnct was in question. Bros aan's affidavit was in the hands of the council when Murphy was requested to appear, yet he was not informed timi the council had the affidavit, nor was he informed of its contents, noi told that he might like to state -My answers t o the allegations. 5 V Mr. Harding submitted that the injunction could not be dissolved in the absence of a telijng ansvver to his par ticular submissions. Replying for Lhe Boxing Council, Mr. J. F. Btevenson said the suspension ,-ould not be interpretated as a revoca iion. There was no contractual relatiou ,ietween the parties. Tlie real reason fo the suspension was Murphy's failure jbo attend the meeting on March 7, Mr. Btevenson criticised tlie applieations f.or an injunction to restore Murphy's lieense. Its objeet was that of gagging narther inquiry. Mr. Harding denied an attempt to gag investigation. "Mr. Stevenson submitted that the injunction was granted without the full facts being before the Court. Judgement was reserved.
