AUCKLAND, Sept. 5. Because no evidence was ealled t* prove iicc used was the driver oi the cai which collided witli a tram 011 the jiight of .Tune 15 when two young women were killed, Mr. .1. 11. Luxlord, S.M., in the Police Court today, d'm missed two charges of negligentlv driv ing'a car -thereliy causing death. Accused was George Robert Ivelly, aged 22, engineer. Tlre victims in tlic iiccident were Raima dean Pringle and Margaret. Wynne (iillespie. "I have not hea'rd any evidence an to who was driving the car," said Mr. J. II. Luxford, at the eonclusion oi" evidence fty- the prosecut ion, adding that all accused said was tliat he drovc the car to a house and had no recolkv tion of what happened after that. Qnestioned by Mr. Luxford, sub r nspector Forsythe, who prosecuted, said he had no further evidence to oH'er. "T will have to dismiss the case unless you can show me who was driving the car," said Mr. Luxford. At this "stage the sub-iuspector pe.rused tlie police lile and brief and then said: "We can only call some of the people who were in the car." Mr. Luxford said: "Well, this young man in on his trial herc today and is entitled to hear all the evidence brought against him.
