H. Levien, S.M., at Auckland yesterday morning concernipg charges against the Civic Theatre Ltd., of keeping the Civic Winter Gardens Cabaret open on a Sunday for transacting business, and against the mangger of the Civic Cabaret, Hector Colin Olsen, of working at his calling in the view of a public place on a Sunday. The prosecution admitted that the Auckland City Council gave the company authority to continue dancing till 1 a.m. on Sundays, pro:vided nobody was admitted after 11.45 on Saturdays, but the police ■held that the council had no right fto over-ride Statute Law, by giving ,perniission to open after midnight. Dismissing the information the Magistrate said . that he could not find anything to support the contention that when a dance was going pn and nobody was getfing in, that place shpuld be deemed to be open.
