APPEAL COURT' S DECISION.

WELLINGTON, -March 30. j Giving the judgment oi' the Appeal j Court this morning in the Mareo appeal case the Chief Justice (Sir Michael | Myers) stated that, without deciding | whether the Court has jurisdiction to | issue a commission for the taking of j the evidenee in London of medical witnesses, and assuming, for the moment that such power did exist, the Court was unanimously of the opinion that an order for a commission should not be made in this case. As this was a novel application, the Court would put its detailed reasons for this decision in writj ing later, but made the decision knovvn at this stage because the main appeal depended to some extent upon it. The Chief Justice added that this deeision affeeted only one of the grounds in the prisoner's appeal against' conviction and left the other grounds open to be discussed at the hearing of th'e main substantive application.
