Charge of armed robbery dismissed
PA Auckland A man accused of taking part in New Zealand’s biggest armed robbery has had the charge against him dismissed. Leslie Maurice Green, aged 49, was charged with two other men after an armed robbery involving $294,524 from an Armourguard van in the Foodtown car-park at Birkenhead on October 19, 1984. Mr Justice Prichard ruled in the High Court at Auckland yesterday that there was insufficient evidence for Green to face trial and discharged him under section 347 of the Crimes Act.
Green was committed for trial with Anthony Riccardo Sannd, aged 34, and Charles Thomas Willoughby, aged 33, on a charge of the robbery after a depositions hearing in the District Court at North Shore last year.: David Valentine Smaller will also face trial, charged with receiving $43,000 of the robbery proceeds from Willoughby. Smaller applied for a section 347 discharge late last year but it was declined. The trial is due to start on April 21 and more than 200 witnesses will be called.
