The British Government is facing demands for legislation to give water authorities the clear legal right to add fluoride to water supplies with the object of preventing dental decay. This comes after last week’s ruling by the Court of Session in Scotland that water authorities north of the border have no legal

power under present legislation to add fluoride though there was no evidence that it could endanger health. Government departments in Britain are evidently closely studying the ruling obtained by Mrs Catherine McColl, aged 69, in a 204day legal battle against the Strathclyde Regional Council. The case, estimated to have cost more than £1 million, was paid for under

the Scottish equivalent of New Zealand’s legal aid system.

Water authorities in England and Wales now add fluoride to supplies in 95 local authority areas under legislation broadly similar to that in Scotland.

One test case has already been started in England but has been held in abeyance pending the outcome of the Scottish case.
