No verdict in trial
A shearer will have to face a second trial on a fatal driving charge.
After a trail which concluded in the District Court yesterday a jury failed to reach a unanimous verdict in a charge against Terry Taranga Henderson aged 29. He had pleaded not guilty to a charge of causing the death of Wendy Iris Dawson, aged 18, by an act or omission while driving with an excessive amount of alcohol in his breath, on state Highway 1, near Rolleston, on September 18 last year.
Prosecution and defence evidence and counsels’ final addresses, were heard on Wednesday. Judge Fraser summed up yesterday morning, before the jury retired to consider its verdict.
The jury announced it could not reach a verdict after a retirement of nearly four hours and a half. The Judge discharged the jury and remanded the defendant to August 15, pending a new trial date. Mr B. M. Stanaway appeared for the Crown, and Messrs M. J. Glue and J. D. Reed for the defendant.
