Lord Diplock to chair hearing
NZPA staff correspondent London The senior British Law Lord, Lord Diplock, will chair the Privy Council Judicial Committee hearing the appeal by a former New Zealand High Court judge, Mr Peter Mahon, over the Mount Erebus disaster inquiry.
The Privy Council hearing will start on July 5. Other members of the Judicial Committee are Lord Keith of Kinkel, Lord Scarman, Lord Bridge of Harwich, and Lord Templeman.
Lord Diplock, once described by “The Times” as a model judge, headed the Judicial Committee when it heard the landmark Samoan citizenship case last year. Lord Keith was also a member of the committee which heard that case. Lord Scarman conducted
the inquiry into the 1981 Brixton riots. Lord Bridge is chairman of the Security Commission. Mr Mahon, who was the Royal Commissioner inquiring into the 1979 Mount Erebus disaster, resigned as a High Court judge after the New Zealand Court of Appeal ruled that he had exceeded his terms of reference. It ruled that his accusation that Air New Zealand attempted to deceive the commission with “an orchestrated litany of lies,” was outside his jurisdiction and a breach of natural justice. Mr Mahon was last year given leave to appeal to the Privy Council against the Court’s judgment.
Most of the month has been set aside for the Privy Council hearing.
