Witnesses risk arrest
PA Auckland Warrants for the arrest of three witnesses were issued yesterday by the Electoral Court hearing the Hunua election petition in Auckland. The order was made after an application by Mr P. B. Temm, Q.C., who is appearing for the petitioners. He said efforts to get the witnesses into court had been unavailing. They were to have given evidence of votes cast in Hunua which the petitioners allege were cast unlawfully.
The three had been served subpoenas to appear on behalf of the petitioners. They were to have given their evidence yesterday morning. They have been given until this morning to appear. If they do not, they will be apprehended by bailiffs and brought before the court. Mr Temm made his application under section 56 of the Judicature Act. The three judges hearing the petition — the Chief Justice, Sir Ronald Davison; Mr Justice Speight; and Mr Justice Sinclair — continued to take evidence from the petitioners.
The unsuccessful National Party candidate for Hunua last year, Winston Raymond Peters, is contesting the election result. He lost to the Labour Party candidate, Malcolm Douglas, by 301 votes. He has challenged more than 1000 votes, alleging that they were unlawfully cast in the seat. He is seeking an order from the court overturning the election or a declaration that it was void. The hearing, which yesterday was in its fifth week, is continuing.
