Motor Spirits Application

Because much valuable time was taken up talking to improve customer relations when pouring petrol, mechanical repair work suffered, Mr L. M. O’Reilly, a counsei for an objector, told the Motor Spirits Licensing Authority yesterday. The proprietor of Breeze Auto Service, Ltd., K. P. Breeze, admitted to Messrs J. W. Bain, F. S. Taylor and G. Laurence under cross-examin-ation, that if his application was successful this time waste could well occur. To remedy it, more overtime would probably have to be worked, Breeze said. Besides himself and his wife he employed two others. Mr O’Reilly said that if the application for a retail motor spirits licence for two pumps and sales otherwise than through pumps was granted for Breeze’s business at 518520 Wairakei road, Christchurch, there would be many

.inherent dangers. The business was undercapitalised and a minor set-back could be fatal. For the New Zealand Retail Motor Trade Association, Mr J. O. Upton said that the petrol company’s relationship with the applicant amounted to an “abnormally high concession.” He contended that legally the applicant had lost his independence and the matter was of vital importance to the industry and his client. In reaching its decision, the Authority noted the concern expressed about the financial position of the business. Although the application passed the substantial garage test, a continuous licence would not be granted. When the property deeds had been transferred, a temporary licence would be issued. The licence, which would be reviewed, would expire on December 31 next year. Although a new accounting system had been adopted, the capital structure of the business would have to be improved, the Authority said.

All local body and National Roads Board requirements would have to be adhered to and sales, otherwise than through pumps, were refused. The application made by M. C. Cuff (Mr J. R. Woodward) for a licence to retail motor spirits from, two screened pumps at his garage at Kaniere, Westland, was adjourned until the next sitting of the Authority in Christchurch. The Minister of Works (Mr Allen) used his discretionary powers under the Public Works Act to object to the application.

Cuff’s business is situated on an intersection on State highway 6 and is the site of a proposed deviation. Although it would be about 10 years before the project was started, he was prepared to operate his business and install two pumps in spite of future plans for his business property, Cuff said.

The Authority adjourned the application until its next sitting in Christchurch. In the meantime, accounts would have to be improved and the local authority. Transport Department and Ministry of Works would have to be satisfied with the application, the Authority said. The Authority granted Hinds Service Store, Ltd., Main South road, Hinds, an application to shift two existing pumps about 80 feet at its premises. The sitting will continue today.
