Judge “Unmoved By Rape Hysteria”
(New Zealand Press Association) AUCKLAND, June 9. When he sentenced Leslie William Emslie, aged 22, a butcher, to two and a half years’ imprisonment for attempted rape, Mr Justice Hardie Boys said yesterday that the current hysteria whipped up about rape cases did not make his task any easier.
“The cry was in such cases to sentence the accused to the maximum and then leave It to others,” he told Emslie. The maximum sentence for attempted rape was 10 years. Normally, in accordance with the Statutes, the maximum sentence for attempted rape was fixed at half that for the full offence.
But the Legislature had shown how gravely it regarded attempted rape by fix-
ing its own maximum of 10 years.
“I am unmoved by pressures at present being exercised,” said his Honour. He imposed sentence on Emslie on the same basis on which he had sentenced every prisoner who had come before him in the last eight years, maintaining a balance of interest between the accused and the protection of the general public. Emstie had pleaded guilty.
