Term “Nigger” Alleged

A New Jersey State Supreme Court has set aside the conviction of a Negro on a manslaughter charge because the judge allegedly used the word “nigger” during his trial. The Court said that it was satisfied that justice had been done in the case and it had reached its decision “with reluctance.” But, it was convinced that the image of the courts would be better served if there was a new trial. In his appeal to the Supreme Court, the Negro, John Roberts, aged 51, said he had been so affected by the use of the insulting word that he had lost his desire to co-operate in the trial. Judge J. Crane, who presided at the trial, said he was “morally certain” that he had never used the word. Roberts had been sentenced to a five to nine years gaol term for the kilting of another Negro.
