Magistrate’s Court Youth Fined £25 For Assault

“You qualify for immediate imprisonment, and it is only with the greatest reluctance that I accept your counsel’s submissions and do not send you to prison," Mr E. A. Lee, S.M., told Frank Sydney Millward, aged 20, a painter, in the Magistrate’s Court yesterday. Millward, who was appearing for sentence on a charge of assaulting Victor Horton Wilson on January 22, was fined £25, and was ordered to make restitution of £5 for damage to the complainant’s watch strap. Mr D. H. Stringer, who appeared for Millward, said that it was Millward’s fifth appearance for offences involving behaviour of this nature. “Where there is a fight. Millward caqnot keep his hands in his pockets. He is irresistibly drawn to join in,” said Mr Stringer. Millward realised that he was knocking on the door of imprisonment In fact he might already be through it Mr Stringer asked that Millward not be sent to prison, as the incident had been more of a drunken brawl than a deliberate assault. The complainant had had a tyre lever in his hand, and this might have had an effect on Millward’s conduct he said. The Magistrate said that the courts had been concerned about the amount of obscenity, disorderly conduct and brawling by louts in the streets, making it unsafe for decent* people to move about. Millward had a wretchedly bad record, he said. THEFT FROM FATHER An 18-year-old mechanic who stole a cheque for £77 from his father, and cashed it, was convicted and remanded in custody to February 10 for sentence. Norman Allan Hewinson pleaded guilty to the charge of theft of the cheque from Keith Witts Hewinson. Senior-Sergeant G. M. Cleary said the accused found the cheque in his father’s wallet. He cashed the cheque at a bank, bought a car for £22 10s, and spent money on repairs. The sum of £43 was recovered in his possession. DANGEROUS MANNER

Darryl Colin Williams, aged 19, unemployed, charged with driving in a dangerous manner, was convicted and fined £l5 and disqualified from driving for 18 months. On a charge of wearing no safety helmet he was fined £5. Williams did not appear. Constable R. L. Stapely said Williams rode a motor-cycle on Seaview road in heavy traffic at a speed he conservatively estimated to be 40 miles an hour. In Pages road he overtook cars in the face of oncoming traffic, and in Bexley road he increased his speed to 55 to 60 miles an hour. Constable Stapely had to call off the chase because of the heavy traffic. He recognised the rider as Williams and saw him go past a short while later at 55 to 60 miles an hour. When seen the next day Williams denied the offence.

He pleaded guilty. REMANDED Graham Anthony Roger Hamilton. aged 13. unemployed, was remanded on ball to February 10 on three charges of theft. John Ferguson, aged 31. unemployed, and Brian Joseph Kennedy, aged 33. unemployed, were both remanded in custody to February 10 on a joint charge of theft of property valued at 125 on January 26. Ferguson was alec remanded on a charge of breaking and entering on February 3. Keith Brian Morgan, aged 35. a drainlayer, was remanded on bail to February 10 on a charge of being in an enclosed yard without lawful excuse on February 3. Wlnlkerel Pouaka. aged 24. a workman, was remanded on bail to February 10 on a charge of breaking and entering a building at 348 Cashel street on February 2. Haami Tahere. aged 18. a boat assembler, was remanded in custody to February 10 on a charge of breaking and entering -348 Cashel street on February 2. Neil Ernest Dempsey, aged 20. a sawmill! hand, was remanded on ball to February 10 on a charge of being Idle and disorderly in that he habitually consorted with known thieves. Malina Samuels, aged 10. a waitress, was remanded in custody to February 14 on a charge of theft of £2O in money from Jean Shierlaw on February 3. Leslie Jqbn Wanhalla, aged 17. a carpenter's labourer, was remanded on bail to February 10 on a charge of being found without lawful excuse on the Theatre Royal building in Gloucester street 'on February 3.
