Magistrate’s Court 14 Days’ Gaol For Being Idle And Disorderly

Found playing cards in the Linwood Railway Station yesterday morning, Herbert Gilmore Scobie, aged 61, later appeared in the Magistrate’s Court on a charge of being idle and disorderly in that he had insufficient lawful means of support. Scobie was sentenced to 14 days’ imprisonment by Mr H. J. Evans, S.M. He pleaded not guilty. Constable D. T. Hore said that at 8 a.m. yesterday he went to the railway station where he found Scobie playing patience. Scobie said he had been sleeping in the station or under nearby trees for the last 10 days. He had 7d in his possession and had nowhere to live. Scobie said he had been recently discharged from hospital, said Constable Hore. He said he only ate when he could get enough money from selling bottles which he picked up along the river. “Last August he was sent to Roto-roa Island for a year,” said the Magistrate, looking at Scobie’s list of convictions. “How does he come to be down here now?”

Sergeant P. J. Alty said that Scobie might have caused trouble at Roto-roa and the authorities there might have refused to deal with him. The Magistrate looked at his card again and said the last conviction Scobie had was for insubordinate behaviour at Rotoroa and he served a month’s imprisonment in Mount Eden Prison.

“Yours is a difficult case,” said the Magistrate. “I don’t know what to do with you really, but I am going to send you to gaol.” (Before Mr E. S. J. Crutchley, S.M.) 18 MONTHS’ PROBATION Appearing for sentence on charges of theft and theft as a servant, Rachel May Struthers, aged 18, a hotel worker, was released on probation for 18 months. She was ordered to live and work as directed by the probation offi-' cer.

Malina Samuela, aged 20, unemployed, was released from custody when she appeared on a warrant for her arrest for failing to comply with conditions of bail. Sergeant Alty said she had failed to report at the police station as required. The Magistrate said that Samuela's explanation that she had been sick, which was supported by a doctor’s certificate, was a proper reason for not reporting. He told her to get friends to advise the police if She was sick again. BURGLARY Charged with breaking and entering a house at 139 Antigua street on December 23, a woman, whose name was suppressed, was convicted and and remanded on bail to January 20 for sentence. She pleaded guilty. Sergeant Alty said that a portable radiogram, records, and meat, worth £33 8s had been taken. When interviewed the accused denied taking any meat. The radiogram was recovered. On two charges of permitting a boy to do an indecent act on him on January 8, Alfred Thomas Vincent, aged 28, a car cleaner (Mr K. N. Hampton) was convicted and remanded in custody to J nuary 20 for sentence. He pleaded guilty.

Sergeant Alty said that Vincent had convictions for similar offences. An application for bail was refused. REMANDED Sydney Sullivan, aged 37. a logging contractor, was remanded in custody to January 17 on a charge of obtaining credit by fraud to the value of £325 on December 31. Tuivasa Falealiii, aged 26. a driver, charged with having unlawful sexual intercourse with a girl aged 12 on January 9, was remanded in custody to January 20. Michael Paul Stone, aged 20, a clerk, was remanded in custody to January 17 on a charge of burglary on or about January 2.
