Magistrate’s Court GAOL SENTENCE FOR DRIVING WHEN DISQUALIFIED

A frequent change of names had made Malcokn Robert Brown a “first offender” on more than one occasion, said Chief Patrol Officer J. Brown, before Mr Raymond Ferner in the Magistrate's Court yesterday. Malcolm Brown, ’ who pleaded guilty to driving wtiile disqualified in Armagh street on April 20. was sent to goal for three month?. His disqualification from driving was extended for two years. Chief Patrol Officer Brown said it was thought the aocuaed’B name was McFarlane. When he appeared under this name at Christchurch on October 24, 1960, he had his driving licence cancelled for one year on a charge of dangerous driving, On October 18, the same man, undet the name Barry, was disqualified from driving for three* months by a Gisborne magistrate. About a month later he appeared in Christchurch under the name Kinnaird, and was fined £2 for mutilating a driving licence. Later, at Bluff, under the name Brown, he was sentenced to a month's goal and seven days* goal, and had his driving licence cancelled for four years,' on charges of driving while intoxicated and while disqualified. “Invaded” by friends cm December 23, Arthur Patrick Tuxford let them all on to his motor-scooter and sert off along Manchester street, he said.

When stopped by Traffic Officer C. Fisk, Tuxford had two passengers behind him, and one on his knees, said Chief Patrol Officer Brown. Tuxford was fried £2 for carrying more than two persons on the scooter, and £2 for having a passenger in front.

DAMAGES CLAIM Rex Arnold Hadfield, a taxi-driver, was granted £26 7* special damages and £3O general damages in a civil claim against Donald Shane Kiel, a labourer, as a result of Hadfield being assaulted by Kiel on September 2 last year. The plaintiff was represented by Mr D. J. Hill, end the defendant by Mr A.

Hadfield claimed £lOO general damages and £5O special damages. He said that as a result of the assault he suffered swollen and split Dips, loosened incisor tooth, a swollen ear, braised legs and shoulders, concussion, and recurring headaches. He was off work for five days. Hadfield said that about 2.30 a.m. on September 2; he received a call from the Blue Star office to take two gallons of petrol to the corner I of Aorangi road and Brookside terrace. He did this and helped two men. one of whom was the defendant, to put the petrol into their car and also to get it going. “Kiel then asked me to follow him to a house in Hollyford avenue where he said he would pay me,” said Hadfield. “He asked me the fare. ' which I told him was 15s, and he said he ’thought it was a bit tough’. He then went into the house and returned with £l. There was a bit of an argument over the price, and he handed me the £1 with one hand and struck me on the head with the other.” Hadfield said he got out of the cab, and there was an exchange of blows between him and Kiel and the other person, Frederick Rangituka Kereoka. He said they attacked him again, and he took a torch from his cab and hit Kereoka with it. He then got into the cab from the passenger side and grabbed the radio telephone and asked the office to send a patrol car to the scene. As he did this the men opened the doors. They started hitting him and pulled him on to the road where he was kicked from “head to toe.” He then lost consciousness. ■ Dr. I. H. W. Sctuires skid : he visited Hadfield twice at ; home and received him once > at his surgery. He said Had- ' field had suffered from the assault but the injuries had not lasted more than a week. In evidence Kiel said the taxi-driver had called him an insulting name. He tried to break up the fight between Hadfield and Kereoka and became involved.
