Attempted Suicide Charge (New Zealand Press Association) TIMARU, April 30. Frederick James Chenery, aged 26, a barman at the Hermitage, Mount Cook, who had elected in the Timaru Magistrate’s Court last month to be tried by a jury on a charge of attempted suicide, today walked from the Timaru Supreme Court a free man after Mr Justice Henry had said that nA indictment should be brought

before the grand jury, and that he should be discharged. His Honour said he had carefully read the depositions from the Lower Court hearing, and, as a result of his consideration of them, had come to the conclusion that he should exercise a discretion under the Criminal Justice Act—that he should direct that no bill of indictment be brought before the grand jury and direct accused’s discharge. It was unlikely, he said, that a grand jury would bring down a true bill, and if it did a common jury would be unlikely to convict him.
