Transport Appeal Dismissed
The Transport Appeal Authority (Judge Archer) has dismissed an appeal by the New Zealand 'Express Company, Ltd., against a decision by the No. 9 Transport Licensing Authority (Mr J. A. Bretherton), amending the company’s licence after a review. Mr R. P. Thompson appeared for the New Zealand Express Company, and Mr W. G. Tiller represented the Railways Department.
“The company operates in a very big way throughout the South Island. This licence is for 26 vehicles, including three for the cartage of furniture throughout the island,” said Judge Archer, in a reserved decision. “The question at issue is whether the company’s rights for these vehicles should be more precisely defined or otherwise amended.
“The company has not satisfied me that the peculiar wording of its licence or the nature of its business justify its claim to wider rights than those granted to its: competitors in Dunedin, after the review of their licences,” Judge Archer said.
