APPLICATION IN COURT WITHDRAWN (New Zealand Press Association) WELLINGTON, July 7. Acting on legal advice, the advocate for the New Zealand Federation of Hotel. Hospital. Restaurant, and Related Trades Employees’ Industrial Association of Workers (Mr F. G. Young) today sought the permission of the Court of Arbitration to withdraw an application for an award to cover affiliated unions. . No opposition was raised by the em- ] ployers’ advocate (Mr J. R. Hanlon), and Mr Justice Tyndall granted the application. , . The hearing of the claims was set down to begin , yesterday morning, but after his Honour had given the opinion that the federation was not entitled to start proceedings the Court adjourned to enable the federation to seek legal advice. When the Court resumed this morning, Mr Young said that the federation’s legal adviser agreed that the citation before the Court was not in order, and he asked leave of the Court to withdraw. “There is a chance that general matters in dispute may now be settled in conciliation.” said Mr Young, “and it is likely that there will be an early meeting of the Conciliation Council.’ At yesterday’s proceedings, members of the Society of Registered Male Nurses of New Zealand asked the Court to exclude them from the provisions of the award relating to hospital workers. Because his Honour questioned whether the society represented workers only, he advised its advocate (Mr D. C. Milne) to seek legal advice whether the society was properly entitled to be heard by the Court. After hearing submissions today by Mr F. L. Curtin, who appeared on behalf of the society, his Honour advised the society to form a legitimate association of workers among its members so that at any subsequent hearing of the award claims their advocate would be entitled to appear.
