SISTERS NON-SUITED
NEGLIGENT DRIVING CLAIM DISMISSED Lilian and Ida Kennard, music teachers, claimed the sum of £ll 15s 8d before Mr G. G. Chisholm, S.M., In the Magistrate’s Court in Christchurch yesterday for repairs to their motor-car after a collision with another in Cashel street on August 28, 1942, owned and driven by Mrs Edith Anne Combes, of Fendalton. The sisters, who were represented by Mr R. A. Cuthbert, were nonsuited. The first-named plaintiff stated that, accompanied by her sister, she was driving their motor-car near the Intersection of Colombo street when a car driven by the defendant pulled out from the kerb and collided. The accident, she submitted, was due to negligent driving on the part of the defendant. "1 had no time to take in the situation,” said the witness.' Mr H. A. Young appeared for Mrs Combes, who denied liability and negligence. The Magistrate said he could not find any fault in the way the defendant had come from the parking area into the busy street. It was not established, he added, that the onus was entirely on her. The plaintiffs were, accordingly, nonsuited.
