Mr A. T. Donnelly (Christchurch) appeared for plaintiff company, and Mr J. W. Hannan for deOutlining the case, Mr Donnelly stated that ttfe company's bottles were well known all over the West Coast, largely used in connexion with their bottled beer trade,, the trade averaging 3000 dozen bottles per annum. £he loss in bottles became so high that the plaintiff company had inserted a warning notice in" the WesJ; Coast papers. As a result, the bottles returned increased considerably. Since July, 1929, defendant had returned none of the plaintiff's bottles and about 50 per eent. of the bottles returned from the West Coast to,' Christchurch bore thp defend- J ant's, label, showing they had been used bv him in the sale of his aerated waters. On the basis of conversion it was claimed that plaintiff, unentitled to damages, arid also to an, injnnctioi. For the defence, Mr Hannan contended that the allegation -was that the trade mark 'had'been uied in the pale of fermented liquor. It was doubtful whether the company was. entitled to register under the classification under which it had registered. Defendant' contended there had been no infringement. Had defendant manufactured any bottles bearing the' plaintiff's trade mark he would have been guilty of'an infringement. . All he ,had done waa to use hot- ■
