Claxton and T. G. de v,-here both parties claimed the right over tile Mount Bisehoff mining area, near the Zeehan mine, on the Thames coast. The Warden said the Court could draw only one reasonable inference from the evidence that de Renjy. on behalf of the New Zeehan Consolidated, held prospecting licenses over the area, but that they, with other assets, were handed over to, or seized by, the receiver for the debenture-holders, and the company ceased to exist. De Renzy had allowed the prospecting license to expire, and Claxton, chairman of a new company, had pegged out the cUim the next day. The Warden heid that de Renzy had failed to establish any grounds for his objection to this, which was set aside. Claxton, therefore, was the prior applicant, and his application was granted with cost? against de Remy.
