UNKNOWN BY-LAW.
♦ LIQUOR AT SANATORIUM. "Described by defendant's counsel as an "unknown by-law" the charge preferred against Oscar Egdcn, licensee of the Sandridge Hotel, at the Lower Court yesterday, was that on October 30th, 1926, ho assisted, counselled, or procured George Brydon in the commission of introducing spirituous liquor into tho Upper Sanatorium, Cashmere. Mr F. D. Sargent, for defendant, said that tho by-laws dealing with this matter had never been gazetted, and no one seemed to know anything about them. Defendant had no idea that ho had been committing an offence, and other licensees in town had not known of tho existence of these by-laws. 'Joseph Kearney said that on October 30th last ho had been given a parcel by Mrs Egden to take to the Sanatorium gates, where he was to give it to a man, who did not put in an appearance. He then left the parcel in the long grass inside the gates, and when ho returned for it, it was missing. He had not known what was in the parcel, but it was heavy. He suspected that it was liquor. To Mr Sargent witness said that he had left the liquor about 15 yards from the gate. He did not know that he was committing an offence.
Mr Sargent stated that it was a very grave thing not to make a by-law known, and ouo of the reasons for the police bringing tho case was to direct public attention to the by-law. The information was dismissed without prejudice.
