CHARGE AGAINST MILK VENDOR FAILS.

Mr l'oyntoii, S.M., dismissed a charge* in the Court to-day agaiiut the Auckland Milk Comxiany that it eold milk that failed to stand what, is known as the reductive test. A sample was taken from on© of tho company's milkmen. For the defence it was contended that tho test known oa the'Methylene- Bluo *«gt was not reliable, tliut the regulation is uncertain unci unreasonable, and that proper precautions were not taken between the buying of the sample and tho application of the test. The Magistrate saiel that iho regulation undoubtedly meant milk "when purchased." Though the milk in question would not stand tho test at 30 a.m., it might have do.no bo at G. 55 a.m., when purchased. Ho found that the tent was satisfactory and reliable, and that the regulation is not tinreasonable. There was a doubt wbother or not tho milk wfculd have passed the teat when purchimcd, and defendant was entitled to tho benefit of the doubt. Tho charge would bo dismissed.
