WRIT OF ATTACHMENT.
Mr W. J. Sim. moved, on behalf of Michael Fitzgerald, railway employee, John Fitzgerald, farmer, of Glentunnel, David Fitzgerald, threshing-mill owner, of Ashburton, and James Joseph Fitzgerald, clerk, of Methven, for a' writ, of attachment againbt Andrew- Fitzgerald and William Fitzgerald,fanners,' of Ashburton, and executors of the' .will of the late David Fitzgerald. On February 9th, 1925, hie Honour Mr ■Justice Adams ordered defendants to takean account before- the Registrar of the Court, of suoh moneys or funds or other property comprised in - the estate as had .come into their hands as executors and trustees of the estate; of such moneys or :other property-which, hut for. the wilful default, of the defendants, would have, come .into their hands;-of such'moneys, or .ptW property which have been lost - to the estate by'reason of a breach -ct breaches of trust by either or both of the defendants; of the dealing generally with and investments of such moneys, funds' and other property by the defendants or either of them. Defendants had been given 14 days in whioh to supply this information. There was no appearance . of either 'of the defendants, and they were not represented. Mr Justice Adams made an order for a writ of-attachment, with: oost3 £7 73, and disbursements against defendantsi ' .i MAGISTERIAL. THURSDAY; (Before Mr H. Y. •. Widdowson, S.M.) DRUNKENNESS.' A first offender was convicted and fined 10s, jn default 24 hours' imprisonment. ADMITTED TO PROBATION. Appearing .on remand for sentence, a young man named Robert Hector Butcher, aged 24 .years, a., confectioner, who had previously admitted having stolen £1 on June 2nd., the property of the Sydenham Picture Company, had nothing to say. . Accused was convicted and. admitted to prpbation for a term of three years. • Special terms included the refunding of the £1 to the Picture Company. OBSCENEI LANGUAGE. When charged with having . -used obscene language in Springfield road, St. Albans, on Wednesday, Albert Edward' Mackinson, 39 years of. age, pleaded guilty. . His Worship convicted and, in lieu of other ' punishment, ordered him to be detained in, the inebriates' home at Roto Roa. for > a period of 12 months Accused's wife, Louisa Eliza Sarah Mackinson, charged her husband, from whom eho was separated by an order of the Court, with having trespassed on her property. However, this charge, was withdrawn' by leave of the Court. CIVIL BUSINESS. Judgment by default was given for plaintiff in each of the following cases:—R. T. Tosswill v. landia Soap, Candle and Tracing Co., Ltd. v. H. Findlay, £l3 14a lOd. Jamc3 Holland was ordered to pay the sum of £1 7s to Leonard Arthur Truman, in default two days' imprisonment. TENANCY. A labourer named George Coppin, of Mad-, ras street, Christchurch, was'fiucd by William Thompson, of Christchurch (Mr J. B. Batchelor), for possession of a tenement situated in.Madras street, and for £4 17s 6d. After hearing the evidence his Worship gave judgment for the defendant with costs. MERCHANTS'. CLAIM. ' Park, Davis and Co., Lichfield street," fruit and produce merchants, claimed from H. Wood, James street, Redcliffe, the sum of £l-lls 3d for fruit and produce supplied. Judgment was given for the company for £1 9s 3d with costs.
