The reserved decision, c-f Mr E. D. Jlosley, S.M., in the casa in which 0. Digby, Ashburton, proceeded against P. Stephens, of Hokitfkn, for tbc sum of £3 Ss, waß given on Friday. The case, was heard on April 3rd, and invo.ved the question of whether a trainer has authority to pledge on owner's credit. Mr R. Kennedy appeared for the plaintiff md Mr A. K. North for the defendant. This is apparently the first occasion on which defendant s "namo was mentioned. Plaintiff posted the account to defendant, who promptly repudiated liability. It is clear from this evidence. that the odntract was made by the plaintiff with Kingan, and that ' plaintiff looked to Kingan to pay. _ At the time the contract Was mad® plaintiff seems to have faiied to make enquiries a* to the ownership of the horse, nnd seems to havfr been quits satisfied to loqk to Kingan-- for Payment. Ko\v the only ground on which this action can he sustained against Stephen? is that Kingan acted as his agent or 4er- ; wit, Md that he had authority, express or implied, to pledge his principal s credit. It is i clear item tlie evidence that Kmf>an hid nd «xpre«B authority to pledge defendant's credit for anything. Had Kingan any implied authority so to do? What are the facts? I' find that tl"> contract was made by and with Kingan, that no mention wius niado of Stephens in the matter until ft later period, and that plaintiff looked to Kingan for payment. The defendants nam® is not introduced iftto the matter at alt until aft&r the interview on the Ashburton railway station. Plaintiff acted ■on the contract made "tritH him by Kingan and on iwlhiiiff else. I. am satisfied tihat the fact that a person other than Kingan would pay liia aoctmnt had at that time nfcver occurred to plaintiff. It appears te> me that there is no evidence to fix liability on' to the defendant in this citse. I am entirely -unable to aaeumo that it must bo taken as common knowledge that traihera haVe authority to nledee their owners' credit for loose-boxM and fot, hoard, 'tic? am I aware that any such custofn exists from which implied authority imght 'bs deduced. Judgment will therefore be for the defendant with costs. The Magistrate further added that a gijat deal of the evidence had been irrelevant, and addressing Mr Kennedy etitcd: "I sympathise with your client entirely, and thiik that lie is an honest man who has beett takeA down.
