Plaintiff •stated that the cheque was signed by Thomas Hardy, of Ash burton, who had given it to..Whitford, inpayment for. a ■x)Uie. Plaintiff, not knowing that Wnrdy'e account was overdrawn, gave Whiti'ord five sorereigns on the chequo, -whfih presented, turned out valueless. He added that he felt Gorry for Whit ford, and had only brought the matter before the Bench in to protect himself. Tho Bench remarked that Whitford •was rather unfortunate, but as he had given an endorsement be had made himself responsible for the money.
