The Auckland University College Council again discussed tho Senate's refusal to recognise tuition given by the Auckland College in engineering subjects.
The discussion was the outcome of a reply received from the Education Department to the Council's request for a statement of the legal position of the attitude taken up by the Senate in regard to tho engineering course. It was staged in reply that it was contrary to the practice of the Department to give legal advice to statutory bodies which had their own legal advisers, and moreover, that in any ca*o the- Department could not see its way to interfere between the Senate and the College Council.
Mr Mahon moved that- the matter bo referred to the Council's legal advisers.
Mr - Peacocke, in seconding, pointed out that the Council had only asked that Auckland students should* have a two years course at the local University College.
Professor Segar said the position was ihat the Senate could not legally act against it.s own statute. However, ho would voto for the motion.
Mr Peacocke said it was not a question of legal right, but of moral right. Mr Beatty said that if it was proved that the action of the Senate, was prejudicial to the University College, it was open to tho Council to endeavour to have the Senate's authority limited. The motion was carried unanimously.
