ACTION AGAINST THE BANK OF NEW ZEALAND.

WELLINGTON, February 3.
Mr Justice Edwards gave a decision this morning on ths law r-ointe in the case G. W. Banks v the Bank of New Zealand, claim £1000 damages for dishonouring a cheque. The plaintiff instructed a clerk to pay in £137 to his account. The clerk niadd out the paj>in slip in the wrung name, but the acCoiintiint of tho bank gave thtr receipt a* though the money had been paid to plaintiff's account. The money was not put to his account, and when t-li-e cheque was presented it was dishonoured His Honour held that on the law points the neglect was on the purt of the plaintiff's clerk, not on tho part of the bank, which was not compelled to ishow that the receipt corresponded to the ps.y-in slip. The facce of the ca-% have yet to be gone into.
