FORGED CHEQUE; COMMITTED FOR SENTENCE

The forging and presentation <of a cheque resulted in a married woman being committed by Mrs D. Petty and Mr J. Rutherford, J’s. P., to the Supreme Court for sentence.

In the Whakatane Court on Mon-f-day, Maraea Hawera, of Ruatoki, married with four children was charged that on August 26 she knowingly made a false cheque for £23 15s purporting to be signed by Kitty Tihi and that, knowing it to be forged, she caused J. J. Laskey to act upon it as if it were genuine. James John Laskey, radio dealer, of Whakatane, said that accused brought an open cheque to his shop. It purported to be signed by Kitty Tihi, of whom he knew. Accused said the cheque had been given her by Kitty Tihi to pay £lO deposit on a radio. He gave accused change and kept the cheque. When he went to deliver the radio to Kitty Tihi, she denied having ordered it. The cheque was returned to him by the bank marked “No Account.” He had since been fully paid the amount of his loss.J

Kitty Tihi, married, told the Court that she had no account at the bank concerned. Accused had once seen a cheque with her signature.

T. Tiopira, a farmer, of Ruatoki, said accused was His daughter and lived at his home with her husband and children. Tiopira said he had an account at the bank concerned. He usually kept his cheque book locked in a box. His daughter could have obtained access to it. The cheque which was the subject of the charges was from his book. Accused pleaded guilty and was committed for sentence.
