Judgment Against Plaintiff In Claim For Damages To Car
Judgment in favour of the defendant was given by Mr E. L. Walton S.M., in the Whakatane Magistrate’s Court yesterday when John Alexander Johnson (Mr 8.. S. Barry) mill employee, Te Teko, claimed damages amounting to £4B 10s from Percy Pankhurst Woods (Mr W. Holland, Tauranga) sawmiller, Te Teko. Johnson claimed the damages, which had risen out of a collision •between his car and a timber truck owned by Wood on the Matahina Road, Te Teko, on December 1, 1948, and he alleged that the driver of the truck had been negligent in colliding with his car.
Evidence was given by Charles Zinsli, panel beater, Whakatane, who repaired the car, and by A. P. Smith, sawmiller, Te Teko. Frank Foote, driver of the truck at the time of the collision, also gave evidence.
