Breach Of Rule Not Proved
Because no evidence had been given to establish that defendant was at fault a charge of a breach of the right hand rule against John Gates, timber worker, Mt. Roskill, was dismissed by Mr E. L. Walton, S.M., in the H Whakatane Magistrate’s Court yesterday. Mr A. Carling, county traffic inspector, gave evidence that he attended the scene of a collision between two cars at the corner of the Ohope and Maraetotara roads on December 29 last. Measurements were taken and although he had been near the scene of the accident he had not witnessed it.
Appearing for defendant Mr B. S. Barry said that it could not be proved that his client was in any way the cause of the collision and he asked for it to be dismissed.
