JURY DISAGREES
THIRD TRIAL ORDERED DELAYED WHAKATANE CASE The new trial granted by the Court of Appeal of Alfred James Gillespie, hairdresser, of Whakatane, aged 38 (Mr Trimmer), was concluded on Wednesday before Mr Justice Callan. There was. one charge against Gillespie of unlawful carnal knowledge and two of indecent assault on a girl 13 years of age. The Crown Prosecutor, Mr V. R. Meredith, represented the Crown.
After a retirement of four hours and 40 minutes the jury was unable to agree. Mr Cleal, for the Crown, applied for a retrial at the next session and this was granted. Mr Trimmer applied for bail, which was fixed at £IOO, with one surety of £IOO, and special condi 7 tions, identical with those imposed earlier by the Court of Appeal, were again imposed.
