REPRESENTATION

WHAKATANE HOSPITAL BOARD MR H. C. McCREADY’S POSITION The following letter was minuted on to the Whakatane County Council by the Hospital Board and considered at yesterday’s meeting. “In the examination of the Board’s annual returns it was noted that Mr H. C. McCready vacated his office under section 24 (f) of the Hospitals and Charitable Institutions Act, 1926, as a representative of the Whakatane County Council, but was re-appointed by that body. In this connection, attention is drawn to Section 25 of the Act which provides that when a representative of a contributory district vacates his office the contributory local authority of the district shall appoint some qualified person “in his place.’ It would, therefore, appear that a valid appointment has not been made.” The council resolved that Deputy Director-General of Health be asked if the opinion expressed in his letter was based on the authority of a Crown Law Office or other legal opinion—that such gentleman be advised that before re-appointing Mr McCready to the Bay of plenty Hospital Board this council obtained two legal opinions, each of which advised that such reappointment of Mr McCready was valid.
