RENOVATIONS INSISTED ON

In furtherance to its efforts to improve conditions at the Awakeri Boiling-down or manure works the Whakatane County Council at its meeting yesterday decided that it was not prepared to relicense the establishment next year in its present condition and that the proprietor be -asked to state what his renovation or rebuilding proposals were.

The Department of Health (Gisborne) in response to the query as to whether the Council would legally be able to acquire a site under the Public Works Act for the purpose of erecting thereon a boilingdown works, stated that there was no authority which, would permit the Council to acquire land for that purpose. The Council had power under Section 9 sub-section 2 of the Meat Act 1939 upon certain -conditions to‘establish an abattoir and by Section 10, as incidental thereto, to carry on boiling-down works.’ However, such boiling-down works in conjunction with an abattoir would not be for the use of boiling-down diseased animals or carcases which were unfit for human consumption. The purport of the, Meat Act was that the Local Authority should -itself control and manage the abattoir, but by Section 16 the Local Authority might delegate its powers to an approved Firm or Company but there was no provision however, for the delegation of a boiling-down works as distinct from the abattoir. Therefore there was no Authority under the Health Act, nor provision made, to meet these circumstances under the Meat - Act 1939 and in consequence, if the council still desired to proceed with the acquiring of a site, and the erection of the works, it should go to the Legislature and obtain Statutory Authority to establish and lease such Works. . V-/ The Council realised that -the works were a big asset to the district and that the proprietor was doing his. best to cope with a tremendous volume of work. Nevertheless in view of the public duty it was compelled. to perform it was felt that at least it should' bring matters to a head and then give the necessary consideration to a remedy. 1
