“I think you are getting full value for your losses in this claim, but as the defendant is not here and is apparently not
sufficiently interested to speak on his own behalf, I will give judgment for the full claim and costs against him.” In this manner Mr E. L. Walton, S.M., summed up a case of sheepworrying at Ruatoki on November 19 last when C. A. and F. J. McCracken claimed the sum of £6B from Thompson Biddle the owner of dobs alleged to have been responsible for killing and injuring a number of sheep on plain-
tiff’s farm. F. J. McCracken in evidence, said that he saw defendant’s dogs worrying the flock and when they were driven off discovered 2 ewes and 3 lambs killed; 3 ewes and 1 lamb so seriously injured that they had to be killed and 5 other sheep and 4 lambs seriously injured. The claim was based on ewes with lamb at £2 10s each and lambs which were killed or rendered of no value at 20s each. There was a further claim based on general damage to the flock which had been badly worried making the ewes, as witness alleged, useless for feeding the lambs. As a result of 123 lambs, only 40 could be classed as fat and the balance were good only as dogs meat.. The Magistrate gave judgment for £6B plus costs amounting to £6.
