QUESTION OF LIABILITY TAURANGA J DECLINES ACTION No action was taken by the Tauranga (bounty Council at its last monthly meeting in connection with a letter received I'rom the N.Z. Fanners' Union (Auckland) asking it to give consideration to the taking out of an insurance cover over cream stands. When the letter hail been read Cr S. G. Williams said that the Taurangn Co-operative Dairy Association had. an insurance scheme. Th need for caution was expressed by tlie County Clerk (Mr p]. M. Fox) who detailed the insurance scheme conducted by the dairy association. "Why should wo accept responsibility?" asked Cr G. P. Spratt ? who added that if the council insured it accepted liability and he refused to accept liability. The position was further discussed the County Clerk remarking that there was no liability on the council while it left the question as it was. Cr Spratt: We should get a ruling. We could argue here for a month. The County Clerk referred to a legal opinion which had been obtained. Jt was stated that once the County Council recognised the fact that a cream stand was in existence and exercised any control over it it became liable for any accident which might arise through it.
