THEFT OF TENT

CHARGE AGAINST NATIVE CONVICTED AND DISCHARGED Rather unusual circumstances sur rounded a charge of theft against . a native, Tau Apiata, avlio appeared at the Opotiki Police Court, " charged AA'ith stealing a tent, the property of Mr W. J. Walker, Waihou Bay, on January 14. The ten I Avas valued at £5, and the alleged offence took place at Waihou Bay. Accused elected to be dealt Avith summarily, pleading not guilty. In outlining the case, Sergeant Isbister said that on or about 20th ' December, Mr Walker had a ten? erected for a worker. On January 1 14th missed the tent. Constable Hira located the tent in an old car parked outside Mr Drake's house. Accused had Avritten to Avitness stat- : ing that he intended to plead guilty and asked him not to call Avitnesses. Grave Doubts. After a god deal of evidence and questioning, the Bench said it Avas of the opinion that accused Avas the main responsible for the taking of the tent. HoAvever, they had grave doubts whether the others Avere not a party in it. Accused Avould be convicted and discharged Avithout a fine. lie would have to pay the costs which amounted to £15 6s 3d.
