MAORI PLEADS GUILTY SECOND CHARGE OF ASSAULT Whaiti Hona appeared before Messrs G. A. Brabant and R. W. Schofield, Justices of the Peace, on Monday morning charged that on May 25th, at Whakatane he incurred a debt of liability, to wit: a meal valued at 2s ;;1. with Peter Smeljan and did obtain credit by fraud. A second charge of assaulting Palricia Walsh was also preferred. Accused elected to be dealt Avith summarily and pleaded guilty to both counts. Sergeant M. Farrell said that at about 7 p.m. on Saturday Hona Avent into Smoljan's restaurant and had a meal. He left without paying and AA r as seen by the Avaitress. Accused pushed the Avaitress violently, injuring her hand. Accused, said the Sergeant, Avas an invalid and had been in receipt of -i Social Security pension. He AA r as not fit for imprisonment. In ansAA'er to a question by the Bench Sergeant Farrell said that Hona haxl had a feAV drinks. Likely to Lose Pension. Hona told the Court that the Avaitress had not giA r en him a chance to pay. She had telephoned the police immediately. Sergeant Farrell handed to the Bench the statement made by the AA'ai tress. It had been stated that accused's mother Avas in Court and was prepared to pay her son's fine. This A\ r as commented on by the Bench. "It's a bit rough on your mother to Ito pay the fine but you haA r e to be punished. It is really a case for Ihe Supreme Court but you elected to be dealt Avith here and you Avill ha v.; to be fined." The Bench also pointed put that Hona was likety to lose his Social Security pension as a result of the conviction. Hona AA r as fined £1 and 10s costs on the first charge and ordered to ;,ay 2s 3d for the meal. On the second he was convicted and fined £3 and it AA r as ordered that £1 of this should be paid to the Avaitress for her suffering, after it AA'as pointed out by Sergeant Farrell that her hand Avas injured and she A\as likely to be oft AA-ork for some days as a consequencc.
