Prosecuting, Sergeant M, Farrell detailed the facts leading up to the charge and said that on the nighb in question accused, together with two companions, was drinking in a right-of-way between a dance hall and the residence of George William Clark. The right-of-way actually formed part of Clark's j>roperty and when he arrived home and saw the three men drinking he remonstrated. with them. Jainieson's companions left when requested but accused argued and struck Clark, breaking his nose. In inflicting a fine of £10, t,o be paid forthwith, the Bench observed that the case was of a serious nature and Jamieson was fortunate that a charge had not been laid under the Crimes Act* which provided for a severe jjenalty.
