George Simpkins, storekeeper, Wbakatane, deposed i Prisoner hud lived in that district thrett or four months, and 'left about three weeks ago j never employed prisoner ; before leaving, prisoner represented he was going to Napier to got some momy from his brother ; witness trusted him with i% suit of clothes, and lent him 108 for expenses on the . journf-y to Tauranga \ ■ neve* authorised prisoner to collect monies from any- - body anywhere; never entered into partnership with him, or allowed hitn to transact any of witness's business ; had no partner whatever ; there i is no such firm as Siinpkiua. and Brooking % j received order, signed by prisoner " Simpkins and .Brooking," through Mr Wrigley; wrote Mr | Wrigley that the order was wrong and valueless j I the urder now produced (£7 2s 9d), is al&O valueless. To the Court: Never owed prisoner any money j , prisoner has no hotel or property whatsoever at I Ohiwa, Sergeant JSaden deposed that he had received the prisoner into the gaol at Tauranga, by virtue of a warrant. The prisoner, who made no defence, waa fully committed to take his trial at tho nest criminal sittings of the Supremo Court. A?T IMPOSITIOK. Henry Brooking was then charged with imposing upon Captain Skeet, "with a riew to obtain a benefit," contrary to section 4, subsection 3, of the Vagnmcy Act. Sergeant Nadon conducted the prosecution. Tho prisoner said, " I acknowledge giving him ' tho receipt, but I never asked him for any money." It appeared from the evidence that the prisoner applied to Captaiu Skeet for payment of £5, alleged to be due to Mr Simpkins. of Whakatane. Prisoner stated that he was a partner with Mr Simpkins, and duly authorised to reoeivo monies on account of the former. Captain Skeet admitted the debt, but brought a claim against the prisoner privately for a similar amount ; and the prisoner then said, *« I'll set the one against tho other," and gave Captain Skeet a receipt for £5, signed by prisoner " Simpkins and Brooking." Captain Skeet considered that he hau discharged.bis indebtedness to Mr Simpkins, and the prisoner had received the benefit of having paid his own private debt by such receipt. The Court reserved judgment until the following day at noon. " Tuesday, December 21.' BEG IN A V. BROOKrNO. -.<, The Bench ,said a legal difficulty had arisen, and the prisoner would bav*> the benefit of the doubt.—Charge dismissed. DBUKKBK"NK>B. Anew arrival from Mer'-ury Bay was charged with this offence, and diamond with a caution. Another man from Mercury Bay was charged with drunkenness, using ob««en'j language, and also with assaulting the police. The prisoner pleaded guilty, was eevereij cautioned, a id fined in all 35s and costs. A few unimportant civil caaea were ah) heard.
