CLAIM BY SHAREMILKER

The hearing of a ease George Edward Geary, sharemilker, Hikutaia, Thames County (Mr. Garland), v. the New Zealand Co-operative Dairy Company, Limited (Mr. North), a claim of £1250 damages for injuries arising out of a hot water pipe accident at Hikutaia dairy factory, was concluded before Mr, Justice Fair and a jury in the Supreme Court yesterday afternoon. In reply to plaintiff's allegation that the accident resulted from the faulty or unsafe condition of the apparatus provided by which hot water was put in their empty cans by suppliers, the defence led evidence to show that the apparatus at the time of the accident was in good order, was the customary style of apparatus, and subject to need for only ordinary prudent care by the user.

The amount of special damages claimed was reduced by agreement from £250 to £190 and the jury returned a verdict for plaintiff for £190 special damages and £100 general damages. Judgment was entered accordingly.
