ILLICIT SALE OF DRINK
An application to have a case stated for the Court of Appeal was made by Mr. Sullivan for Bartual Martinovlch, boarding house keeper, aged 59 years, when the latter came before Mr. Justice Fair for sentence on a charge of selling liquor without a license, on which a jury had found him guilty. After argument his Honor said he would not grant the application, and Mr. Sullivan called medical evidence as to the state of prisoner's health being likely to withstand the rigour of imprisonment. His Honor said that Martinovich had been twice previously convicted of the same offence and had been fined £30 and £50.
