IN BANKRUPTCY.
COURT ORDERS MADE.
ONE DISCHARGE REFUSED.
"If a man manages to incur liabilities of £2000 in twelve months and is unable to pay any portion of them, he is not the kind of man who should be in business of this kind," said Mr. Justice Fair to-day, sitting in the Supreme Court to consider bankruptcy applications, and an application for discharge made by D'Arcy Wood, of Auckland, who had become' bankrupt as a builder. On bankrupt's behalf, Mr. Bennett made a plea for discharge, despite the fact that the Official Assignee did not recommend it, and mentioned in his report that no books had been obtainable. His Honor added that the bankruptcy had happened only three years ago, and nothing had been done. A discharge would not help the man in his present position as land salesman, and it was not a case for allowing the man to go into business again on his own account. The motion for discharge would be dismissed. A motion for the discharge from bankruptcy of Robert Fewell, of Auckland, salesman (Mr. Mason) was granted. An order was made annulling the bankruptcy of Joseph William Hodgson, of Auckland, retired butcher (Mr. Mason), who said a settlement had been made with the only creditor. Application by R. V. Thompson, insuri ance clerk, Auckland (Mr. W. W. King) |to have set aside a bankruptcy notice I was granted, and a declaration was mrdcj declaring that he had committed no act of bankruptcy. I An order was made adjudicating G. W, I A. Pickering, storekeeper, of WoodhiH. a bankrupt.
