INDEMNITY CLAIM.
THIRD PARTY RISK.
REFORM ACT INVOKED.
The claim before Mr. Justice Fair in the Supreme Court in which H. H. Sheldon, of $«w Lynn (Mr. V. R. Meredith), proceeded under the Law Reform Act for indemnity or contribution from R. J. Reddish (Mr. A. K. North) in respect to £380 paid to Mre. Beatrice Mortlock for damages arising out of a motor accident, was concluded yesterday afternoon with a judgment for plaintiff.
Plaintiff and defendant were drivers of cars which collided at the intersection of Great North-Road and Portage Road, and Mrs. Mortlock, a passenger in Reddieh's car, was injured and recovered £380 from Sheldon.
After having heard evidence and legal argument, his Honor decided that there was negligence on Reddieh's part. He said Sheldon was entitled to an indemnity for the amount paid with costs, and made an order accordingly. The. judgment was given subject to the question of law whether in proceeding under the Law Reform Act the Court is required to proceed,on the assumption that the defendant has been negligent to some degree.
