ANZAC DAY ACCIDENT.
DAMAGES FOR COLLISION. Mr. F. K. Hunt, S.M., gave his decision at the Magistrate's Court in a case arising out of a . collision which occurred on Anzac Day. Arthur Smitheman (Mr. 8. W. Tong) sought to recover from Victor Baker £201 7/ as damages for injuries sustained. Messrs. Harrison and Gash were joined as defendants, as they were the employers of Baker. Mr. Sellars appeared for the defence. The accident occurred on April 23 in Dominion Road. The defendant Baker was driving a motor car, and plaintiff was on a bicycle. Plaintiff claimed that the accident was due to negligence on. the part of Baker. This was denied by defendants, who entered a counter-claim for £20. After hearing a lot of evidence Mr. Hunt dismissed the counter-claim and found that plaintiff .was entitled to damages with costs. It was agreed that the damages will be assessed at a later by Mr. Hunt if the contending parties cannot decide upon the amount.
