Mr. A. Bruce was assessor for the Borough Council, and Mr. B. W. Alison for the company. >ir. T. Cotter appeared for complainants, and Mr. F. Karl for defendants, who put in a denial of any liability. Mr. Cotter, lii opening the case, pointed out that the question to be decided was .whether iho upper road in question, constructed by the OLmemuri County Council prior to the formation of the borough, was a permanently constructed road, and, if so, wnat damages should/ be 'awarded. The actiou was brtHighfrindcr- 205 of tho-Manicipal ' Corpo'faticn Act, wh. n provides that if any road is-constructed i> any .permanent manner, compensatiou shn iOe paid. The case is important; and great iattrest i≤ teintj taken in it locally.
